Urgent "First Sale" Customs Declaration for US Importers
 

Effective August 20, 2008 - all importers are required to advise whether the transaction or commercial value is a "First Sale", according to US Customs & Border Protection.

In a transaction involving a series of sales, the price of the most recent sale (before the introduction of the goods into the United States), instead of an earlier sale, would be considered the price actually paid or payable for the goods when sold to importing parties in the US.

It is only necessary to report importations for which "First Sale" applies. The importer will be required to provide this information via statement on the commercial invoice. This declaration may also be made to IFF via email, fax, or letter.

If "First Sale" applies to all of an importer's importations then this should be communicated, or you have any questions regarding this announcement, please contact your IFF representative.

ISF - Importer Security Compliance
 

Formally known as the 10+2 requirement


In January of 2008 - U. S. Customs and Border Protection (CBP) published a Notice of Proposed Rulemaking (NPRM) requiring importers and carriers to electronically submit additional information on cargo before it departs the foreign port and is brought into the United States by vessel.

The Security Filing, also known as "10 + 2", is another step in the Department of Homeland Security's strategy to better assess and identify high-risk shipments to prevent terrorist weapons and materials from entering the United States.

Importers will be required to submit an "Importer Security Filing" containing the following 10 data elements:

Manufacturer (or supplier) name and address
Seller (or owner) name and address
Buyer (or owner) name and address
Ship-to name and address
Container stuffing location
Consolidator (stuffer) name and address
Importer of record number/foreign trade zone applicant identification number
Consignee number(s)
Country of origin
Commodity Harmonized Tariff Schedule number
CBP expects the new rule to be phased in over a period of one year starting in Fall 2008 for Ocean cargo and expanded to other modes of transportation later. The Importer is going to be solely liable and penalties could be equal to the full value of the shipment.
