U.S. Customs and Border Protection (CBP) is increasing its review of importer identity information to ensure importer records are accurate and up to date in accordance with executive order 14411. CBP will enact enhanced security measures to verify details on Customs form 5106, and penalties may result for inaccurate information.

CBP Form 5106 (Importer Identity Form) is the record used by CBP to establish and maintain an importer’s identity in its system. It contains key company information such as the legal business name, physical and mailing addresses, phone number, email address, and company/officer information.

Much of this information was originally provided when your importer record was established, including through the Power of Attorney (POA) and the company details supplied. Because Form 5106 is submitted according to the POA by any broker a customer may have used, it is important to ensure that the information on file still reflects your current company details and matches CBP’s importer record. As CBP increases its scrutiny of these submissions, proactive steps should be taken.

What should importers do?

We strongly encourage all importers to confirm that the information associated with their CBP importer record and current Power of Attorney (POA) remains accurate.

Particular attention should be given to:

  • Legal company name

  • Physical and mailing addresses

  • Email address and telephone number

  • Corporate officer/individual who signed the broker’s POA

When should you request a new POA?

Please contact IFF to request a new Power of Attorney if any of the following apply:

  • The corporate officer who signed your current POA has left the company or is no longer an authorized officer.

  • Your company's legal name has changed.

  • Your company's address has changed.

If only your telephone number or email address has changed, please contact IFF so that the appropriate importer information can be reviewed and updated.

Maintaining accurate importer information is an important part of customs compliance.

With CBP placing increased scrutiny on importer identity information, reviewing your records now may help prevent questions or potential clearance delays on future shipments.

IFF customers who are unsure whether their information is current are encouraged to contact their IFF representative. We will be happy to review the information we have on file and advise whether an updated POA or importer record update is needed.
