Guidance on China's reciprocal 10% tariff for 90 days

The message from the U.S. Customs and Border Protection (CBP) provides guidance on implementing the Presidential Executive Order (EO) titled "Modifying Reciprocal Tariff Rates to Reflect Discussions with The People’s Republic of China," issued on May 12, 2025.


  1. Updated Information: This CSMS message updates previous CSMS messages 64680374, 64687696, and 64701128 with new information.


  2. Guidance on Tariffs:

  3. Imported products from China, including those from Hong Kong and Macau, entered for consumption or withdrawn from warehouse for consumption on or after 12:01 a.m. Eastern Daylight Time on May 14, 2025, will be subject to a reciprocal tariff of 10%.

  4. Filers will report such products under heading 9903.01.25, which assesses an additional ad valorem duty rate of 10%.

  5. The 10% reciprocal tariff replaces the previous 125% reciprocal tariff for products from China, including those from Hong Kong and Macau, due to a 90-daysuspension articulated in the Executive Order (see below for link) .


  6. Filers will discontinue the use of heading 9903.01.63


  7. Additional Duties: Products from China and Hong Kong remain subject to an additional ad valorem rate of duty of 20% as imposed by the IEEPA Fentanyl tariff, as well as approximately 25% as imposed by the Section 301 tariffs, and any other antidumping and/or countervailing duties as applicable.


  8. Guidance for Trade Community: The CBP will continue to provide additional guidance to the trade community through Cargo Systems Messaging Service (CSMS) messages. Importers and traders are advised to stay informed about the latest updates and ensure compliance with the new tariff rates and regulations.

The information provided above applies to entries arriving on or after May 14th and will not be applied retroactively to shipments that have already been cleared.
